Digitally Fit Club

Terms & Conditions

The terms that guide your use of our website and digital services.

Effective date: September 25, 2026

These Terms & Conditions govern your purchase and use of website design, development, maintenance, creative, and related digital services provided by Digitally Fit Club LLC (“Digitally Fit Club,” “we,” “us,” or “our”). By purchasing a service, accepting a proposal, or asking us to begin work, you agree to these terms.

1. Services and project scope

Your selected package, proposal, order confirmation, or written project agreement describes the services, deliverables, pricing, and estimated schedule for your project. Starter, Essential, and Premium Web Packages include only the features shown at the time of purchase. Landing pages, redesigns, maintenance-only work, custom integrations, added pages, and work outside the agreed scope may require a separate quote.

2. Client responsibilities

You agree to provide accurate information, timely feedback, approvals, brand assets, copy, images, account access, and other materials reasonably needed to complete the project. You confirm that you have permission to use all materials you provide. Delays in providing content, access, feedback, or approvals may extend the project timeline.

3. Payments and recurring care

Project fees are due according to the checkout terms, invoice, or written proposal. Work may be paused when a payment is overdue. Ongoing care plans are billed on a recurring basis and may include hosting, routine updates, maintenance, and support as described in the selected package. Third-party fees—including domains, premium plugins, stock assets, advertising, special integrations, or outside services—may be billed separately when they are not included in the package.

4. Revisions and changes

Reasonable revisions are limited to the scope and revision rounds stated in your package or proposal. A request that changes the approved direction, adds functionality, adds pages, or otherwise expands the original scope may be treated as a change request and quoted separately. We will communicate any added cost before beginning out-of-scope work.

5. Timelines and approvals

Project schedules are estimates and depend on timely client participation and third-party availability. When we request review or approval, you are responsible for checking content, spelling, links, pricing, legal language, and other business information. Final approval authorizes us to proceed with launch or delivery.

6. Ownership and portfolio use

After all project fees are paid, you receive ownership of the final custom deliverables created specifically for your project, excluding our pre-existing tools, processes, reusable components, licensed assets, fonts, themes, plugins, and third-party materials. Unless you ask us in writing not to, we may display completed work in our portfolio, social media, and marketing materials.

7. Third-party platforms

Projects may rely on third-party hosting providers, payment processors, plugins, themes, analytics tools, social platforms, domain registrars, or other services. Their availability, pricing, policies, security, and performance are outside our control. You are responsible for complying with any third-party terms that apply to your accounts.

8. Client content and legal compliance

You are responsible for the accuracy, legality, and rights associated with your business content, claims, products, services, trademarks, privacy disclosures, and policies. Unless separately agreed in writing, our services do not include legal, tax, accessibility, or regulatory advice. You should have appropriate professional advisors review any language that requires legal or regulatory approval.

9. Cancellations and refunds

Cancellations and refund requests are handled under our Refund Policy, which is incorporated into these terms. Amounts attributable to completed work, approved milestones, and nonrecoverable third-party costs may be non-refundable.

10. Warranties and limitation of liability

We will provide services with reasonable care and make reasonable efforts to correct defects reported within the support period included in your package. Except where prohibited by law, services and third-party tools are otherwise provided without additional warranties. Digitally Fit Club will not be liable for indirect, incidental, special, or consequential losses, lost profits, lost data, third-party outages, or circumstances outside our reasonable control. Our total liability relating to a project will not exceed the amount paid to us for the specific service giving rise to the claim.

11. Governing law

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Before starting formal proceedings, both parties agree to make a good-faith effort to resolve any dispute directly.

12. Updates to these terms

We may update these terms from time to time. The version posted when you place an order or accept a proposal will apply to that purchase unless we agree otherwise in writing.

13. Contact

Questions about these terms can be submitted through our contact page.
